Janet Lim Napoles, dating kongresista na si Arrel Olaño ‘guilty’ sa PDAF Scam –Sandiganbayan

HINATULANG guilty ng Sandiganbayan ang negosyante at mastermind umano sa pork barrel scam na si Janet Lim Napoles, kasama ang dating kongresista ng Davao del Norte na si Arrel Olaño.
Sa inilabas na desisyon, guilty sina Olaño, Napoles, at iba pang kapwa-akusado na sina legislative liaison officer Maria Rosalinda Lacsaman, Mylene Encarnacion at Evelyn de Leon sa tatlong counts ng graft at tatlong counts ng malversation of public funds.
Dahil diyan, sila Olaño, Lacsamana, Napoles, at Encarnacion ay hinatulan ng pagkakakulong ng anim hanggang sampung taon.
Bukod diyan, Inutusan din ang apat na ibalik ang P1.89 milyon sa National Treasury.

Kung matatandaan, ang isyu ay kaugnay sa paglipat ng Priority Development Assistance Fund (PDAF) sa Countrywide Agri and Rural Economic Development (CARED).
Para sa kaalaman ng marami, ang CARED ay isa sa mga pekeng NGO na binuo ni Napoles.
Kasama niya riyan ang dating kanang-kamay na si Benhur Luy na layuning simutin ang pondo na mula sa PDAF ng mga mambabatas.
Ayon sa mga kaso laban kina Olaño, Napoles, at iba pa ay P2 million mula sa PDAF ng mga dating mambabatas ang inilaan sa CARED upang mapondohan ang pekeng livelihood project para sa mga barangay.
Hinatulan din si Olaño ng “direct bribery” dahil napatunayang tumanggap siya ng P3.175 million mula kay Napoles matapos ilipat ang mga halagang P8.5 million, P2 million, P4 million, at P2.5 million sa CARED at Philippine Social Development Foundation Incorporated (PSDFI).
“It was established that Olaño exercised control over the release of his PDAF,” saad sa desisyon na pinirmahan ni Associate Justice Edgardo Caldona.
Dagdag pa, “He initiated the release of the funds by unilaterally (endorsing CARED and PSDFI to implement supposed certain projects.”
“Accused Olaño failed to justify the reason why he endorsed (the) said NGOs, which was clearly established as fake, unqualified, and/or unaccredited,” paliwanag pa sa desisyon.
Sey pa sa ruling, “Further, Luy testified on the manner by which PDAF is diverted to accused Napoles through the selection and endorsement of the lawmakers of Napoles’ NGOs to be the project implementer of the former’s PDAF.”
“The transactions funded by the PDAF of accused Olaño were considered irregular and illegal after special audit for being violative of existing laws, rules, and regulations and for being unliquidated,” giit pa.
Samantala, sina Olaño, Lacsamana, Napoles, at de Leon ay sinentensiyahan ng anim hanggang sampung taong pagkakakulong para sa dalawa pang kaso ng graft.
Inatasan din silang ibalik ang P3.83 milyon at P2 milyon sa National Treasury.
