Rape, acts of lasciviousness' case laban kay Vhong Navarro ibinasura ng Supreme Court

Vhong Navarro at Deniece Cornejo

IPINAG-UTOS ng Supreme Court 3rd Division ang pagbasura sa “rape” at “acts of lasciviousness” case laban sa Kapamilya TV host-actor na si Vhong Navarro.

Base sa resolusyong inilabas ng Supreme Court ngayong araw, ipinaaabswelto ng korte ang mga isinampang kaso ng dating model na si Deniece Cornejo kay Vhong dahil sa “lack of probable cause.”

Sa 43-pahinang ruling mula sa 3rd Division ng SC, pinaboran ang Petition for Review on Certiorari na inihain ng legal team ng komedyante na nagresulta nga sa pagpapawalang-sala sa kanya.

“Accordingly, the Court DISMISSES the following Informations against Ferdinand ‘Vhong’ H. Navarro for lack of probable cause.

“The Decision dated July 21, 2022 and the Resolution dated September 20, 2022 of the Court of Appeals in CA-G.R. SP No. 166222 are reversed and set aside,” ang bahagi ng resolusyon.

Ayon pa sa SC Division, “CoA erred in finding that the DOJ committed grave abuse of discretion amounting to lack or excess of jurisdiction in dismissing the Third Complaint for rape and attempted rape against Navarro for lack of probable cause.”

“Here, the prosecutor had reasons to doubt the veracity of Cornejo’s accusations, as the glaring and manifest inconsistencies pointed out in her complaints are readily discernible by common sense without need of rigorous examination or an expertise of a trial court judge for such purpose.

“To suggest that a prosecutor turn a blind eye to such glaring and manifest inconsistencies–under the premise that the evaluation thereof would already touch on the complainant’s credibility to be solely assessed in a full-blown trial–would be to compel the prosecutor to satisfy himself or herself to mere allegations in a complaint, and abdicate his or her bounden duty to screen cases for trial, thus passing the buck to the trial courts,” ayon pa sa SC ruling.

Si Associate Justice Henri Jean Paul Inting ang pumirma sa ruling with concurrences from Associate Justices Alfredo Benjamin Caguioa (chairperson of the division), Samuel Gaerlan, Japar Dimaampao and Maria Filomena Singh.

Pansamantalang nakalaya si Vhong matapos magpiyansa ng P1 million matapos makulong sa NBI Detention Center at Taguig City Jail.
