Petisyon laban sa ekstensyong hiling ni Bongbong Marcos sa kasong diskwalipikasyon, ibinasura ng Comelec

HINDI kinatigan ng Commission on Elections (Comelec) ang hiling ng petitioner na bawiin ang utos nito na nagbibigay ng palugit kay Ferdinand “Bongbong” Marcos Jr. sa pagsagot nito sa petisyon na madiskwalipika siya sa karera sa pagkapangulo.

Sa desisyon ng Comelec second division na inilabas sa mga mamamahayag ngayong Huwebes, sinabi nito na may kapangyarihan ang poll body na isuspinde ang “reglementary period provided by the rules” sa interes ng hustisya at mabilis na pagresolba sa kaso.

“Under this authority, the Commission is similarly enabled to cope with all situations without concerning itself about procedural niceties that do not square with the need to do justice, in any case without further loss of time, provided that the right of the parties to a full day in court is not substantially impaired,” ayon pa sa desisyon ng Comelec.

“In view of the foregoing, the Commission hereby resolves to deny the motion for reconsideration filed by petitioners,” dagdag nito.

Noong Nobyembre 18, kinatigan ng Comelec second division ang apila ni Marcos na bigyan pa siya ng limang araw para sagutin ang petisyon na humihiling na makansela ang kanyang kandidatura. Ang orihinal na petsa ng pagsagot ay nakatakda noong Nobyembre 16.

Umalma dito ang mga petitioner at binanggit na ayon sa Section 4 (6) ng Rule 23 ng Comelec Rules of Procedure, na inamyendahan ng Comelec Resolution No. 9523, sinasabi na walang ground para sa anumang ekstensyon sa pagsagot ng petisyon.

Idinagdag pa ng mga petitioner na ang desisyon ng Comelec noong Nobyembre 18 na ekstensyon ay wala na ring bisa dahil natapos na ang panahon sa pagsagot sa petisyon noong Nobyembre 16.

Ayon naman sa Comelec, sa bisa ng Section 4, Rule 1 sa 1993 Comelec Rules of Procedure, ang komisyon ay may kapangyarihan na isuspinde ang mga panutunan nito.

“In the interest of justice and in order to obtain speedy disposition of all matters pending before the Commission, these rules or any portion thereof may be suspended by the Commission,” ayon dito.

“It is worth stressing that a case is best decided when all contending parties are able to ventilate their respective claims, present their arguments and adduce evidence in support thereof. The parties are thus given the chance to be heard fully and the demands of due process are subserved,” ayon sa desisyon ng second division.

“Verily, in the exercise of its power to suspend its rule under the provisions of Rule 1, Section 4 of the Comelec Rules of Procedure, in the interest of justice and the significance of the case at hand, the Commission (Second Division) deems it proper to allow both parties to be heard. Thus the instant Motion is denied,” dagdag nito.

Sa reklamong diskwalipikasyon ng mga petitioner, sinabi nilang hindi kwalipikadong tumakbo sa anumang pampublikong pwesto si Marcos dahil nahatulan siya noong 1995 ng Quezon City Regional Trial Court sa kasong hindi pagpa-file ng income tax returns.

Ang mga petitioner ay binubuo ng mga political detainees, human rights groups at medical organizations.

Ang ikalawa at ikatlo pang petisyon na nananawagang makansela ang kandidatura ni Marcos ay isinampa ni Dr. Rommel Bautista, na namumuno sa grupo ng mga taxpayers at organisasyon ng mga aktibistang ikinulong noong panahon ng martial law.
