Ipinababasura ng Office of the Ombudsman sa Sandiganbayan ang hiling nina Sen. Jinggoy Estrada at Janet Lim Napoles, ang inaakusahang pork barrel fund scam queen, na baliktarin ang nauna nitong desisyon at hayaan silang makapagpiyansa sa kasong plunder.
Ayon sa prosekusyon walang bagong argumento na naipresinta si Estrada at Napoles sa P183 milyong plunder case kaya dapat na ibasura ng Fifth Division ang kanilang apela.
“Demonstrating unparalleled hard-headedness, both accused Senator Estrada and Napoles try to put the assailed resolution under the microscope…(but) no amount of legal hermeneutics and nitpicking will save (them) form the inevitable – their continued incarceration,” saad ng Office of the Special Prosecutor.
Sa kanyang motion for reconsideration, sinabi ni Estrada na nagkamali ang Sandiganbayan ng hindi ito pumayag na siya ay makapagpiyansa dahil ang mga ebidensya ng prosekusyon ay peke at hindi maaaring magamit sa pagdinig.
Hindi rin umano magagamit na ebidensya ang external hard drive ng whistleblower na si Benhur Luy dahil kahina-hinala ang pinangalingan at pagtatago rito.
Sinabi naman ni Napoles na walang pirma si Napoles sa alinmang dokumento na may kaugnayan sa mga bogus na non-government organization.
Sa mga NGO napunta ang pork barrel fund ni Estrada na tumanggap umano ng komisyon.
“The prosecution has convincingly proven that the evidence of guilt against accused Senator Estrada and Napoles is clear, convincing, and strong. Their culpability has been established by evidence clearly revealing their sinister design,” ayon sa prosekutor.
