Nadine kinontra ng korte, inutusang tapusin ang kontrata sa Viva
LUMABAS na ngayong araw, Hunyo 14, ang resolusyon ng Quezon City Regional Trial Court sa isinampang petisyon ng Viva Artist Agency hinggil sa contract star nilang si Nadine Lustre.
Ito’y may kinalaman sa naging desisyon ni Nadine na lisanin ang management company niya noong nakaraang taon at hindi na tapusin ang ilang taong kontrata nito.
Ayon sa pahayag ng RTC, dapat tapusin ni Nadine ang obligasyon niya sa Viva bilang exclusive contract artist at pinagbawalan pang tumanggap ng trabaho na hindi alam o walang go signal ng nasabing kumpanya.
Base sa nakasaad sa resolution, “Petitioner has established its unequivocal right arising from the subject Revised Agency and Management Agreement.
“It has established that respondent [Nadine Lustre) contracted with them to act as sole and exclusive manager for respondent’s exercise of profession in the show business.
“The contracts entered into by Nadine with Viva were executed with the assistance and presence of her parents at the time she was a minor. Nadine’s contracts with Viva mutually benefitted from their contractual relationship.
“The Court further said that the contract between the parties is the law between them and Nadine cannot take the law into her own hands and unilaterally terminate her contract with VIVA.”
Sabi naman ng legal counsel ng VAA na si Atty. Paolo Roxas, “With the Court’s ruling, Nadine is precluded from entering into and/or performing contracts involving her services as an artist/endorser, without the consent and participation of Viva.
“As provided by her contract, any issue raise by Nadine against Viva should be the subject of arbitration proceedings.”
Anyway, Enero 2020 ay naglabas ng official statement ang legal counsel ni Nadine na si Atty. Lorna Kapunan na puwedeng hindi na tapusin ng aktres ang kontrata niya sa Viva Artist Agency base sa Article 1920, Civil Code of the Philippines.
Ang nakasaad sa nasabing aktikulo, “The principal may revoke the agency at will, and compel the agent to return the document evidencing the agency.”
Sabi pa ng abogado ng aktres, “Nadine is self-managed and will continue to be so on indefinitely. She shall direct manage her affairs from now on, and bookings and inquiries may be directly addressed to her.”
Pinaratangan din ni Nadine ang Viva ng, “unconscionable, oppressive, and illegal” kaya naghain ng petisyon ang kumpanya laban sa aktres.
Sa kasalukuyan ay hindi pa naglalabas ng pahayag si Atty. Kapunan pati na rin si Nadine tungkol sa ipinalabas na resolusyon ng QCRTC.
