Kinondena ng Bayan Muna ang pananatili sa puwesto ng mga opisyal ng Energy Regulatory Commission kahit na sinuspinde ng Ombudsman ang mga ito.  Ayon kay Rep. Zarate napatunayan ng Ombudsman na guilty sa conduct prejudicial to the best interest of the service, aggravated by simple misconduct at simple neglect of duty sina ERC Commissioners Gloria Victoria Yap-Taruc, Alfredo Non, Josefina Patricia Magpala-Asirit at Geronimo Sta. Ana at dapat ay agad na suspendihin ang mga ito.  “They committed an offense detrimental to the public and they should be made accountable and not treated as sacred cows,” ani Zarate.  Magsasampa rin ang Ombudsman ng kasong graft laban sa apat at isasampa rin si dating ERC Chair Vicente Salazar.  Ang kaso ay kaugnay ng pagpapalawig ng ERC ng deadline para sa competitive selection process para sa pagbili ng kuryente mula Nobyembre 9, 2015 hanggang Abril 30, 2016. Dahil sa ginawang ito ng ERC, pumasok umano ang Meralco sa pitong kasunduan kung saan lugi ang publiko. “In fact, with the Ombudsman’s findings, the Office of the President can even dismiss these erring commissioners and appoint news ones who would really look out for the best interest of the consumers,” ani Zarate. Sinabi ni Zarate na mayroong silang mga nakukuhang impormasyon na dumadalo pa rin sa hearing ang mga suspendidong opisyal. Ang ERC ay pinamumunuan ngayon ni Agnes Devanadera. “This clearly defiant act can place these commissioners, including Chair Devanadera, for another graft and corruption charges,” dagdag pa ni Zarate. “We call on the Office of the Ombudsman to strictly enforce its suspension order and not allow this blatant disregard of its authority by these ERC officials.”
