POSIBLENG ipatanggal ng korte kay Darryl Yap at ng kanyang film company sa social media ang teaser video ng pelikulang “The Rapists of Pepsi Paloma.”
Ito’y matapos maghain ng petition for writ of habeas data nitong nagdaang Lunes, January 6, ang TV host-actor na si Vic Sotto, sa Muntinlupa Regional Trial Court (RTC) Branch 205.
Kaugnay pa rin ito ng lantaran at diretsahang pagbanggit sa pangalan ni Bossing Vic sa teaser ng pelikula ni Direk Darryl na “The Rapists of Pepsi Paloma”.
Base sa report, kinatigan ng Muntinlupa RTC Branch 205 ang petition for writ of habeas data na inihain ng kampo ni Bossing dahil sa nag-viral at nag-trending ang inilabas na video ni Darryl Yap kung saan lantarang sinabi ang name ng komedyante sa rape case ni Pepsi Paloma.

Maaaring pagbawalan din ng korte ang grupo ni Darryl Yap na maglabas at mag-distribute pa ng karagdagang anumang “promotional materials, teasers, and other content.”
“May utos na po ang korte sa writ of habeas data na ito ay lumalabag sa karapatan ng ating kliyente kung kaya’t pansamantala ay grinant ang habeas data,” ang pahayag ng legal counsel ni Vic na si Atty. Enrique Dela Cruz sa isang panayam.
“Ibig sabihin ay tigilan muna natin ang pagpo-post, pagse-share ng mga bagay na ito hanggang sa ito ay mapag-usapan,” dagdag pa niya.
At tungkol sa pagpapatanggal nga ng teaser video ng pelikula ni Darryl Yap, sabi ng abogado, “Kasama po yun sa hinihintay namin sa writ, kasama sa hinihingi namin yun. At wala pa po kaming kopya ng writ, pinakautos ng korte.”
Dagdag pa nito, nag-file sila ng petisyon sa korte para maprotektahan ang buhay at privacy ni Bossing at ng kanyang pamilya, kabilang na ang wife niyang si Pauleen Luna at anak na si Tali.
Nakasama din sa habeas data petition ni Bossing ang kanyang judicial affidavit na ang Pepsi Paloma movie ay nagresulta sa, “threats upon my life, and that of my family, as seen in Facebook comments and private messages sent to us.
“I felt unsafe and afraid since I read comments from strangers threatening to rape my wife and my minor child.
“I also felt that my right to privacy was being violated because this rape accusation is NOT TRUE and the dissemination of this wrong information is fooling a lot of people,” sey pa ng veteran TV host.
“As advised to me by my lawyers, under the Data Privacy Act, information related to any proceeding for any offense committed or alleged to have been committed by such person, as well as the result of such proceedings is sensitive personal information.
“Since Darryl admits that the subject of the case is the case filed by Pepsi Paloma against me, he is without a doubt processing my sensitive personal information,” dagdag pa niya.
Nauna rito, naibalita rin natin ang pagsasampa ni Bossing ng 19 counts of cyberlibel laban kay Direk kasabay ng paghingi ng P20 million danyos.
