Nadine kinasuhan ng Viva, lumabag daw sa kontrata na tatagal pa hanggang 2029

KINASUHAN ng Viva Artists Agency si Nadine Lustre sa Regional Trial Court ng Quezon City nitong Biyernes dahil sa patuloy na paglabag nito sa kanyang exclusive contract.

Ilang beses na raw na nilalabag ng aktres ang ilang kasunduan nila ng kanyang talent management kabilang na ang pakikipagkasundo sa ilang advertisers at promoters na ipinagbabawal sa kanyang kontrata.

Unang pumirma ng 5-year exclusive contract sa VAA si Nadine noong 2009 at ni-renew ito noong 2014 para sa susunod pang 10 taon o hanggang June 30, 2024.

Ni-renew uli ang kontrata noong 2015 para sa karagdagang limang taon kaya tatagal pa hanggang 2029 ang contract ni Nadine sa Viva.

Sa official statement ng VAA, sa pamamamagitan ng legal counsel ng talent management na si Chino Paolo Roxas, inisa-isa nila ang mga dahilan kung bakit idinemanda na nila si Nadine.

Narito ang bahagi ng pahayag ng VAA, “VIVA Artists Agency, Inc. filed today a lawsuit against its talent, Nadine Lustre before the Regional Trial Court of Quezon City.

“The lawsuit was filed because, early this year, Nadine violated her valid and existing Agency and Management Agreement with VAA, by contracting independently with advertisers, promoters, and other third parties, in utter disregard of the exclusivity of her contract with VAA.

“Thus, the case seeks, among others, to stop Nadine from continuously violating her Agency and Management Agreement with VAA and for Nadine to honor her contract?”

Kasunod nito, nabanggit din sa statement ng Viva kung paano nila ginawang “one of the most sought after artists in the entertainment industry” ang aktres kasama pa ang ka-loveteam nitong si James Reid

“Through VAA’s efforts, Nadine’s career took-off in 2014 owing to the Viva-produced blockbuster movie Diary ng Panget starring Nadine and James Reid, which introduced the JADINE loveteam to the public.

“On the heels of the success of Diary ng Panget, VAA negotiated for JADINE to be featured in ABS-CBN shows to promote the loveteam, resulting in the record-breaking teleserye, On The Wings of Love, more popularly called by fans as OTWOL.

“Despite her continued success as an exclusive artist of VAA for almost a decade, Nadine still chose to violate and disregard her contract with VAA.”

“Ms. Lustre should honor and respect the sanctity of contracts and that third parties are put on notice that any direct dealings with Ms. Lustre for her services as a performing artist or endorser shall be in violation of Ms. Lustre’s contract with VAA.”

Kung matatandaan, inihayag ng legal counsel ni Nadine na si Atty. Lorna Kapunan noong January, 2020 ang desisyon nitong kumalas na sa Viva sa kabila ng exclusive contract niya.

“For the information of the public, Nadine Lustre is no longer a talent of Viva Artists Agency.

“Consistent with her rights under the Civil Code of The Philippines, specifically Article 1920, she has decided to terminate her agency contract with Viva.

“As of now, Nadine is self-managed and will continue to be so indefinitely.

“She shall directly manage her affairs from now on, and bookings and inquiries may be directly addressed to her.”

“The principal may revoke the agency at will, and compel the agency to return the document evidencing the agency. Such revocation may be expressed or implied,” ang bahagi pa ng pahayag ng kampo noon ni Nadine.
