IKINADISMAYA ng Bayan Muna ang pagtatalaga kay Mocha Uson bilang Deputy Administrator ng Overseas Workers Welfare Administration.

Ayon kay Rep. Ferdinand Gaite dapat ay saklaw pa ang one-year ban ni Uson dahil tumakbo ito bilang representante ng AA KASOSYO partylist sa nakaraang eleksyon.

Sa ilalim ng 1987 Constitution at Local Government Code hindi maaaring kumuha ng appointed position sa loob ng isang taon ang mga tumakbo sa pinakahuling eleksyon.

“This Constitutional prohibition is applicable to party-list nominees and Mocha Uson being the first nominee of AA KASOSYO Partylist, and who participated in the 2019 Party-list elections, is covered by the 1-year ban. So her appointment as the Deputy Administrator of OWWA is illegal and should not be enforced,” ani Gaite.

Nakasaad sa Section6 ng Article IX ng Konstitusyon: “ No candidate who has lost in any election, shall within one year after election, be appointed to any office in the government or any government-owned or controlled corporation or in any of its subsidiaries.”

At sa Local Government Code: “Section 94. Appointment of Elective and Appointive Local Officials; Candidates Who Lost in an Election. – (a) No elective or appointive local official shall be eligible for appointment or designation in any capacity to any public office or position during his tenure.”
