Kaso vs Cebu gubernatorial bet Winston Garcia ibinasura

Ibinasura ng Sandiganbayan Second Division ang kasong paglabag sa Anti-Graft and Corrupt Practices Act (RA 3019) laban kay dating Government Service Insurance System president Winston Garcia at walong iba pa kaugnay ng eCard project nito noong 2004.
Sa 15-pahinang desisyon, sinabi ng korte na nalabag ng Ombudsman ang karapatan ng mga akusado matapos nitong isampa ang kaso makalipas ang mahigit 10 taon mula ng ihain ang reklamo nito.
“Accordingly dismisses the case for violation of the Constitutional precept on speedy disposition of cases and for want of probable cause,” saad ng desisyon.
Kapwa akusado ni Garcia ang mga dating opisyal ng GSIS na sina Enriqueta Disuanco, Hermogenes Concepcion, Jr., Elmer Bautista, Fulgencio Factoran, Florino Ibañez, Reynaldo Palmiery, Ellenita Tumala-Martinez, at Leonora Vasquez-De Jesus.
Noong Abril 1, 2005, sinampahan ng reklamo sa Ombudsman ang mga akusado kaugnay ng pagpasok ng GSIS ng kontrata sa Union Bank of the Philippines para sa pondong nakalaan sa eCard System.
Hindi umano ito dumaan sa public bidding kaya mayroong nalabag na batas.
Inabot ng mahigit 10 taon bago naisampa ng Ombudsman ang kaso sa Sandiganbayan.
“It is unfortunate that the office tasked to protect the people is the first to contribute to its hardship and suffering,” saad ng desisyon ng Sandiganbayan.
Sinabi ng korte na ipinagpatuloy din ng mga pumalit na opisyal ng GSIS ang programa at walang inilabas na Notice of Disallowance ang Commission on Audit laban dito.
“Any imputation of violation of section 3 of RA 3019 in the procurement of the Union Bank as eCard partner of GSIS would be more speculative than real, considering that the project continues to be implemented by the succeeding officials of GSIS and no affected party, including the banks that submitted proposals, raised a whimper about it,” saad ng desisyon.
