SC hiniling na baliktarin ang naging desisyon kaugnay ng DQ vs Poe

HINILING ngayon sa Korte Suprema na baliktarin ang naging desisyon nito matapos namang ideklarang ligal ang pagtakbo ni Sen. Grace Poe sa pagkapangulo sa Mayo 9.
Sa isang joint motion for reconsideration na inihain nina Atty. Estrella Elamparo, dating Sen. Francisco “Kit” Tatad, dating University of the East Law Dean Amado Valdez at political science Professor Antonio Contreras, iginiit nila na isang panggulong kandidato ang maihalal sakaling manalo si Poe.

“Such ignominy will forever taint the Honorable Court’s legacy,” sabi ng mosyon.
Sa botong 9-6, idineklara ng Korte Suprema na karapat-dapat na tumakbo si Poe.
Idinagdag nila na hindi maaaring ikonsidera si Poe na isang natural-born citizen dahil pito lamang na mahistrado ang bumoto pabor sa kanya.
“By inserting into our jurisprudence a kind of profiling that could be considered racist in character, when it has for the first time used as basis for justifying the claim of petitioner [Poe] of being natural born the physical appearance of a person by referring to a ‘Filipino look,’” ayon pa sa inihaing apela.
Idinagdag ni Elamparo na nilabag ang kanilang karapatan matapos namang hindi sila payagan na kontrahin ang mga datos na iprinisinta ni Office of the Solicitor General.
