Kautusan ng DPWH kaugnay sa right-of-way ng telcos, hiniling na amyendahan

Hiniling ng National Telecommunications Commission (NTC) sa Department of Public Works and Highways (DPWH) na amyendahan na ang patakaran ng ahensiya kaugnay sa right-of-way ng mga telecommunication companies.

Sa liham ng NTC kay DPWH Secretary Mark Villar, sinabi nilang dapat amyendahan na ang Department Order (DO) 73 series of 2014 para mapabilis ang pagtatayo ng mga kinakailangang cell sites ng mga telcos.

Sa ilalim ng DO 73, ipinagbabawal ang pagtatayo ng mga poste para sa mga kable ng telepono at ng mga mobile service providers sa mga gilid ng national roads. Sa halip, ipinag-uutos ng DPWH na ang mga telcos at kanilang contractors ang bahalang bumili ng sarili nilang right-of-way.

“D.O. 73 required phone, mobile, and cable service providers and their contractors to acquire their own right-of-way and directed DPWH Regional and District Engineers to remove all those declared prohibited uses of the right-of-way,” ayon sa NTC.

Ang kautusang ito, ayon sa NTC, ay nagiging sanhi ng pagkaantala ng pagtatayo ng mga kritikal na pasilidad ng mga telco na mahalaga para mapabuti ang serbisyo sa telekomunikasyon at internet connectivity.

Dati nang inatasan ni Pangulong Rodrigo Duterte ang telcos na bilisan ang pagpapaunlad ng kanilang serbisyo lalupa’t tumataas ang internet usage sa bansa simula nang manalasa ang COVID-19.

Sa Memorandum of Agreement (MOA) na nilagdaan sa First Philippine Telecoms Summit noong 2017, nagkasundo ang Department of Information and Communications Technology (DICT), DPWH at NTC sa pangangailangan na amyendahan o baguhin ang DO 73 para wala nang maging hadlang sa pagpapaunlad at pagpapalawak ng telecommunication services at facilities sa bansa.
