Pagdinig sa prangkisa ng ABS-CBN magpapatuloy
MULING magsasagawa ng pagdinig bukas ang House committees on legislative franchise at on good government ang public accountability kaugnay ng prangkisa ng ABS-CBN 2.
Pagkatapos talakayin ang Philippine Depository Receipts na binibili maging ng mga dayuhang investor, isusunod na tatalakayin ang legalidad sa pagbabalik umano sa mga Lopez ng channel 2 na sinequester noon ng Marcos government.
Sa pagdinig noong Huwebes kinuwestyon ng mga kongresista ang pagbebenta ng PDR ng ABS-CBN Holdings maging sa mga dayuhan na maaari umanong paglabag sa Konstitusyon na nagsasabi na Pilipino lamang ang maaaring mag-may-ari ng mass media.
Sinabi ni Dasmarinas City Rep. Elpidio Barzaga Jr., na ang biniling PDR ng mga non-Filipino investors ay may katumbas na shares of stocks ng ABS-CBN Corp.
Punto ni Barzaga kahit na sabihin na ABS-CBN Holdings ang may-ari ng mga shares hindi nito maaaring ibenta ang mag shares na saklaw ng PDR na binili ng mga dayuhan.
“ABS-CBN Holdings is ‘tied to that pledge’ that are the covered PDRs and also covered by ABS-CBN shares. Even the company can’t sell that,” ani Barzaga. “Even if ABS-CBN is the owner, the rights of ABS-CBN are effectively restricted. They can’t sell it. Ownership simply means one can – without any restriction – dispose of a thing that he really owns.”
“If you are a foreigner, of course you will not spend millions of pesos wasting your money if you will not be able to have those covered shares of stocks,” dagdag pa ng solon. “There is a restriction insofar as ownership is concerned. Control comes with the purchase of these foreigners.”
Iginiit ng mga abugado ng ABS-CBN na ang pagbili ng PDR ay hindi nangangahulugan na nagkakaroon ng kontrol sa ABS-CBN Corp., ang bumili ito.
Ayon kay Barzaga ang ibinentang 132 milyong PDR ng ABS-CBN Holdings ay nangangahulugan ng 132 milyong stock ng ABS-CBN Corp., na kontrolado ng mga bumili nito.
Hindi rin kumbinsido ang mga kongresista na walang kontrol ang mga bumili ng PDR sa pamamahala ng ABS-CBN Corp.
