Gabby Lopez ipinagtanggol sa alegasyon na isa siyang Amerikano

HINDI umano totoo na hindi Filipino citizen si Gabby Lopez nang pamunuan nito ang ABS-CBN 2.

Sa isang pahayag, sinabi ni Cagayan de Oro Rep. Rufus Rodriguez na hindi nilabag ni Lopez ang Konstitusyon na nagsasabi na ang mass media ay dapat pagmamay-ari lamang ng mga Filipino.

Paliwanag ni Rodriguez ipinanganak si Lopez sa Estados Unidos noong 1952 at sa ilalim ng American law ay isa siyang US citizen. Pero Filipino rin umano siya dahil ang kanyang mga magulang ay Filipino.

“The fact is that, when he was born, both his parents were Filipinos. So he was automatically a Filipino by birth under the 1935 Constitution, which was the Charter applicable then,” ani Rodriguez.

Hindi umano ni-renounce ni Lopez ang kanyang Filipino citizenship at hindi nito pinili na maging Amerikano. “….he or his network did not violate the constitutional provision on 100-percent Filipino ownership of media.”

Ayon pa kay Rodriguez ang 50-year cap na nakasaad sa Konstitusyon ay ang haba ng prangkisa na maaaring ibigay ng Kongreso sa isang prangkisa.

“The Constitution is very clear. The Constitution says that every franchise that will be issued shall not be more than 50 years. 50 years is not cumulative. Our practice is we grant for only 25 years. But we can fix it at 50 years, 40 years, or one year, as long as it does not exceed 50 years,” ani Rodriguez.
