Kaso vs Purisima, Napenas ibinasura

IBINASURA ng Sandiganbayan Fourth Division ang mga kaso laban kina dating Philippine National Police chief Allan Purisima at Special Action Force Chief Getulio Napeñas kaugnay ng Mamasapano incident kung saan nasawi ang 44 pulis.

“… upon a motu proprio evaluation by the Court of the records of the present cases, the charges against accused (Napeñas) are ordered dismissed for lack of probable cause, without prejudice to the filing of the appropriate charge/s against him,” saad ng 18 pahinang desisyon. “The Motion to Quash of accused Alan Purisma is granted. The charges against said accused… are dismissed without prejudice to the filing of the appropriate charges against him.”

Ang kasong usurpation of official functions at graft ay kaugnay ng isinagawang operasyon ng SAF noong Disyembre 2014 hanggang Enero 2015 para mapatay ang international terrorist na si Zulkifli Abdhir alyas Marwan at Akmad Batabol alyas Basit Usman.

Ayon sa Ombudsman suspendido si Purisima bilang hepe ng PNP subalit ito ang nagmamando kay Napenas sa pagsasagawa ng operasyon na tinawag na Oplan Exodus.

Kasama si Napenas sa kinasuhan dahil alam umano nito na suspendido si Purisima subalit sinusunod niya ito.

“… in dismissing the present cases, the Court does not conclude that herein accused are without any liability in the conduct of the operations of Oplan Exodus. What the Court merely rules upon is the non-existence of probable cause as against accused Napeñas for both charges and the insufficiency of the allegations in the Informations filed against accused Purisima.”

Nauna ng binawi ng prosekusyon ang kasong isinampa nito laban kay dating Pangulong Benigno Simeon Aquino III dahil sa kakulangan ng ebidensya. Pinayagan ng korte ang ginawang ito ng Ombudsman.
