Binay motion ibinasura, kaso tuloy

IBINASURA ng Sandiganbayan ang motion to quash nina dating Vice President Jejomar Binay at kanyang anak na si dating Makati City Mayor Junjun Binay sa mga kasong kriminal na isinampa sa kanila kaugnay ng pagpapatayo ng P1.35 bilyong Makati Science High School.
Ayon sa Fifth Division mayroong batayan ang isinampang kaso ng Ombudsman laban sa mag-ama at dapat na ituloy ang paglilitis sa kasong graft at malversation.
“There is no basis for the accused-movant’s claim that his alleged acts cannot be the basis for alleging conspiracy. That these acts were done in good faith is a matter of defense and should not be considered in a motion to quash,” saad ng resolusyon.
Sa kanilang mosyon, sinabi ng mag-ama na kulang ang mga iprenisinta ng prosekusyon upang pumasok sa graft o falsification ang alegasyon at ang procurement process at trabaho umano ng mga opisyal na mas mababa sa kanila.
“For now, whether [the Binays] carried out [their] functions in accordance with the law is not relevant. As these are extrinsic to the Informations, these are not proper issues for resolution in a motion to quash,” saad ng korte.
Hindi rin kinatigan ng korte ang alegasyon ng mag-ama na mayroong double jeopardy.
“A single act or incident might offend against two or more entirely distinct and related provisions of law, thus justifying the prosecution of the accused (Binay Jr.) for more than one offense,” saad ng desisyon.
