Warrant vs Negros gov, 2 iba pa

Naglabas ng warrant of arrest ang Sandiganbayan Third Division laban kay Negros Oriental Governor Roel Degamo at dalawang iba pa kaugnay ng kasong graft at malversation na kinakaharap ng mga ito.
Kasama ni Degamo na nilabasan ng warrant of arrest sina provincial treasurer  Danilo Mendez at provincial accountant Teodorico Reyes.
“Wherefore, the Court funds the existence of probable cause against accused-movants Roel Ragay Degamo, Danilo Cual Mendez, and Teodorico Guevara Reyes in these cases. Accordingly, let warrants of arrest be issued against them,” saad ng desisyon.
Ang kaso ay kaugnay ng iligal umanong paggamit ng provincial government ng calamity fund nito para sa pagsasaayos ng mga nasira ng magnitude 6.9 lindol noong 2012 at bagyong Sendong noong 2011.
Ayon sa naunang pahayag ng Ombudsman, humingi ng assistance si Degamo para sa rehabilitasyon ng kanyang probinsya para sa dalawang kalamidad.
Noong Hunyo 2012, ipinalabas ng Department of Budget and Management ang P961.5 milyong Special Allotment and Release Order at agad na ipinalabas ang P480.7 milyon para sa probinsya.
Pero makalipas ang ilang araw ay binawi ng DBM ang SARO dahil sa pagkabigo umano ng probinsya na makasunod sa guidelines para sa mga ipagagawang proyekto.
Kahit na wala na ang pondo ay itinuloy umano ni Degamo ang 11 infrastructure contract na nagkakahalaga ng P143.2 milyon. Nagpalabas ng Notice of Disallowance ang Commission on Audit sa mga proyektong ito dahil pinalabas umano na mayroong pondo para rito kahit pa binawi na ito ng DBM.
“If respondents had reservations on the legality of the withdrawal of the positive SARO, they could have asked a higher executive authority or secured a judicial directive allowing them to retain control of the funds released to the province.  This, respondents failed to do,” saad ng desisyon ng Ombudsman.
