Pagbasura ng kaso ni Lorenzo, Bolante inapela

Inapela ng Office of the Ombudsman ang desisyon ng Sandiganbayan Second Division na nagbabasura sa kasong plunder laban kay dating Agriculture Sec. Luis Lorenzo at ex-DA Usec. Jocelyn ‘JocJoc’ Bolante.
Sa 14 na pahinang mosyon, iginiit ng prosekusyon na mayroong probable cause ang kaso at dapat maglabas ang korte ng arrest warrant laban sa mga akusado.
“In the assailed Issuance, the Honorable Court went beyond its authority to determine probable cause for the purpose of the issuance of warrant of arrests, or the matter of probability for such purpose,” saad ng mosyon.
Sinabi ng prosekusyon na ang pagtukoy kung mayroong probable cause sa preliminary investigation ay trabaho ng executive, at ang pagtukoy kung mayroong probable cause para magpalabas ng arrest warrant ay trabaho ng korte.
Noong Disyembre ay ibinasura ng korte ang plunder case laban kay Lorenzo at Bolante dahil sa kakulangan umano ng ebidensya.
Ang kaso ay kaugnay ng paggamit ng P723 milyong fertilizer fund ng Arroyo government na ipinambili umano ng mga overpriced na fertilizer at mga pataba na hindi kailangan ng magsasaka.
Sa naturang halaga P265.6 milyon umano ang napunta sa korupsyon.
“Wherefore, with the foregoing premises, it is respectfully prayed that the Honorable Court Reconsider and set aside its Issuance,” saad pa ng mosyon.
