Sa 31-pahinang petition for certiorari at prohibition, sinabi ni Morales na nagmalabis ang appeals court Sixth Division sa kanyang kapangyarihan nang maglabas ito ng TRO noong Marso 16 at nang atasan ang Ombudsman noong Marso 20 para magkomento sa inihaing contempt ng kampo ni Binay.
“In this case, respondent Binay was placed under preventive suspension pending the resolution of the administrative complaints against him (but not to exceed six months) for good reason – the cases involve anomalies in the procurement and payment for the Parking Building of the Makati City Hall,” sabi ni Morales.
