Herbert Bautista tuloy ang laban sa graft case, nanindigang hindi corrupt

MAGHAHAIN ng motion for reconsideration ang kampo ni dating Quezon City Mayor Herbert Bautista sa Sandiganbayan matapos hatulang “guilty” sa kasong graft kahapon, January 20.
Nanindigan ang aktor at public servant na inosente siya sa mga akusasyong ibinabato sa kanya na may kaugnayan sa “P32.1 million deal with Geodata Solutions Inc.” noong nagsilbi siyang alkalde ng Quezon City taong 2019.
Ayon sa 7th Division ng Sandiganbayan, nilabag ni Herbert at ng dating city administrator na si Aldrin Cuña, ang Republic Act 3019, o ang Anti-Graft and Corrupt Practices Act.
Hinatulan silang makulong ng anim hanggang 10 taon matapos mapatunayang nagkasala dahil sa anomalya sa procurement ng Online Occupational Permitting Tracking System (OOPTS) na nagkakahalaga ng P32 million.

Bukod sa parusang pagkakakulong, hindi na rin sila pwedeng magkaroon ng posisyon sa gobyerno.
“We will definitely prepare and file a motion for reconsideration of this decision,” ang pahayag ng abogado ni Herbert na si University of Santo Tomas (UST) Faculty of Civil Law Dean Nilo Divina sa isang statement.
Aniya pa, “He did not commit any act which constitutes the offense charged. The vote is two against one — meaning there exists a cloud of doubt even among the justices who deliberated on the evidence presented in this case.”
Sa 146-pahinang resolution ng Sandiganbayan na inilabas ni Associate Justice Georgina Hidalgo nabanggit na, “the prosecution failed to prove all the necessary elements beyond a reasonable doubt to justify a conviction.”
“The evidence presented did not convincingly show that accused Bautista and Cuña exhibited manifest partiality, evident bad faith, or inexcusible negligence when they approved and released public funds to Geodata,” ani Hidalgo.
“There is therefore no proof to show that accused Bautista acted with fraudulent intent when he signed the disbursement voucher,” dagdag pa niya.
“It must be emphasized that he never personally and financially gained anything from this project. Not a single centavo went to our client’s pocket,” aniya pa.
