Abugado ni Nadine tinawag na ‘mapang-api, abusado’ ang Viva

Tinawag ng abugado ni Nadine Lustre ang Viva Artists Agency (VAA) na “mapagsamantala, mapang-api at abusado” matapos sampahan ng talent agency ang aktres ng kasong paglabag sa kontrata.

Sa pahayag na ipinalabas ni Atty. Lorna Kapunan, sinabi nito na karapatan ni Nadine na tapusin na ang kontrata nito sa VAA.

“The contract is an agency contract and Nadine is the principal–and it is the right of the principal to terminate the agent when it is not performing its commitments under the agency agreement,” ayon kay Kapunan.

Dagdag nito, “It is her prerogative to continue to earn without VAA getting an unconscionable amount in agency fees which it does not deserve.”

Kinasuhan ng VAA si Nadine sa Regional Trial Court ng Quezon City nitong Biyernes dahil  ilang beses na raw na nilalabag ng aktres ang ilang probisyon sa kasunduan, kabilang na ang pakikipagkasundo sa ilang advertisers at promoters na ipinagbabawal sa kanyang kontrata.

Unang pumirma ng limang taong exclusive contract sa VAA si Nadine noong 2009 at ni-renew ito noong 2014 para sa susunod pang 10 taon o hanggang June 30, 2024.

Ni-renew uli ang kontrata noong 2015 para sa karagdagang limang taon kaya tatagal pa hanggang 2029 ang contract ni Nadine sa Viva.

Kumpyansa naman si Kapunan na “lalabas ang katotohanan” sa umano’y hindi makatwirang pagtrato ng ahensiya at “paglabag sa kontrata.”

“We welcome the complaint and we are confident that the truth will come out about VAA being predatory, oppressive and abusive not only of Nadine but it’s many other talents,” wika ni Kapunan.

“We are prepared to prove VAA’s material breach of the contract. We are likewise prepared to show that VAA is guilty of tortious third party interference by its threatening / pressuring third parties dealing with Nadine in good faith and scaring them with potential court cases,” dagdag nito.

Sinabi pa ng abugado na karapatan ni Nadine na piliing i-manage ang kanyang career.

“Nadine is now self-managing which she has every right to do especially during these difficult pandemic,” wika nito.

Para kay Kapunan, ito ay hindi lamang laban ni Nadine.

“This is not Nadine’s fight alone-it is for all talents/ artists who are similarly situated.”

Sa isinampang kaso ng VAA, sinabi nito na lumabag si Nadine sa kontrata nito dahil sa pakikipag-ugnayan nito sa mga advertisers, promoters at iba pang third party na hindi batid ng ahensiya.

“The lawsuit was filed because, early this year, Nadine violated her valid and existing Agency and Management Agreement with VAA, by contracting independently with advertisers, promoters, and other third parties, in utter disregard of the exclusivity of her contract with VAA,” anang ahensiya.

“Thus, the case seeks, among others, to stop Nadine from continuously violating her Agency and Management Agreement with VAA and for Nadine to honor her contract?” wika pa nito.
