Pagbawi sa kaso vs PNoy pinagbigyan ng korte
PINAGBIGYAN ng Sandiganbayan Fourth Division ang hiling ng Ombudsman na i-withdraw ang kasong kriminal na isinampa nito laban kay dating Pangulong Benigno Simeon Aquino III kaugnay ng Mamasapano incident.
“Considering that the records of the present case are bereft of any evidence that would merit further proceedings as against accused Aquino… and applying the aforementioned jurisprudence pronouncements, the Court finds that the dismissal of the said cases is indeed warranted,” saad ng desisyon.
Ipinag-utos din ng korte ang pagtanggal sa hold departure order at ipinababalik ang piyansang inilagak nito.
Naghain ng mosyon ang Ombudsman upang bawiin ang kasong graft at usurpation na isinampa nito laban kay Aquino kaugnay ng pagkamatay ng 44 na tauhan ng Special Action Force sa Mamasapano noong 2015.
Subalit ang pagbawi sa kaso ay hindi umano nangangahulugan na hindi na magsasampa ng kaso ang Ombudsman.
