Naganap ang insidente dakong alas-7:30 ng umaga, habang nagsi-swimming ang 61-anyos na retiradong heneral sa bahagi ng Batangas Bay na nasa Sitio Ilaya, Brgy. Sta. Clara.‎

Dinala pa si Atienza sa Golden Gate General Hospital, ngunit idineklarang patay ng doktor, ayon sa pulisya.
