Kaso vs Purisima, Napeñas tuloy; guilty rin sa administrative cases

napenas-0210 Tuloy ang pagsasampa ng kaso ng Office of the Ombudsman laban kina dating Philippine National Police Chief Alan Purisima at dating Special Action Force Director Getulio Napeñas kaugnay ng Mamasapano incident noong nakaraang taon.      Napatunayan din ni Ombudsman Conchita Carpio Morales na guilty sa kasong administratibo na Grave Misconduct, Gross Neglect of Duty at Conduct Prejudicial to the Best Interest of the Service sina Purisima at Napeñas.      Dahil nasibak na sa serbisyo si Purisima dahil sa ibang kaso, at nagretiro na si Napeñas sa gobyerno pagmumultahin na lamang ang dalawa ng kasing halaga ng kanilang isang taong sahod.      Hindi na rin maaaring pumasok sa trabaho at wala na silang makukuhang retirement benefits.     Ibinasura ni Ombudsman Conchita Carpio Morales ang mosyon ng mga ito upang ibasura ang kasong paglabag sa Anti-Graft and Corrupt Practices Act at Usurpation of Authority or Official Function.      “Purisima’s active participation and supervision of Oplan Exodus despite the 10 December 2014 preventive suspension order of the Ombudsman and the 16 December 2014 cease and desist order of OIC-PNP Chief Espina both issued against him, violated the PNP chain of command and amounted to usurpation of official functions,” saad ng desisyon ng Ombudsman.      Ang madalas na pagre-report ni Napeñas kay Purisima kahit na suspendido ito at hindi pagpapaalam ng operasyon sa noon ay OIC-PNP chief Leonardo Espina ay nangangahulugan na kasabwat umano siya sa usurpation of official function.      “Napeñas’ plea of leniency on account of his 37 years of meritorious service in government cannot be countenanced by this Office considering that the penalty of dismissal from the service is an indivisible penalty.” 30
