Ibinasura ng Sandiganbayan Fifth Division ang mosyon ni Sen. Jinggoy Estrada na mapanumpa ang kanyang anak na si Janella na nanalong bise alkalde ng San Juan City.
“Wherefore, premises considered, accused Estrada’s Motion if denied for lack of merit,” saad ng desisyon ng korte. “As the Court has long adverted to, only emergency or compelling temporary leaves from imprisonment are allowed to all prisoners, at the discretion of the authorities or upon court orders.”
Sinabi ng korte na ibinasura nito ang mga kaparehong mosyon ni Estrada at wala itong makitang basehan kung bakit nito pagbibigyan ang pagpapanumpa kay Janella.
Hinarang ng prosekusyon ang hiling ni Estrada na makapunta sa 409 Shaw Boulevard, Mandaluyong City mula alas-8 ng gabi ng Hunyo 28 hanggang 2 ng umaga ng sumunod na araw.
“The record do show that the Court has denied accused-movant Estrada’s past motions to be allowed furlough from detention. These motion include those which are grounded on personal reasons and those pertaining to his official duties as a Senator of the Philippines.”
Magtatapos ang ikalawa at huling termino ni Estrada bilang senador sa Hunyo 30 at nais niya na ang panunumpa ng anak ang maging huling aksyon nito bilang mambabatas.
