Bistek lugi, walang makukuha sa yaman ni Kris dahil kay Bimby

MARAMI kaming natututunan sa Media Law and Ethics class namin tuwing Lunes sa ABS-CBN sa pagtuturo ng mahusay naming teacher na si Atty. Katrina Legarda.

Akala kasi natin minsan ay marami na tayong alam sa batas – sari-saring batas ang nadi-discuss namin along the way and Atty. Legarda is generous enough to share with us her thorough knowledge on each of them.

Magaling pa namang magsalita ni Atty. Legarda, buo ang boses at matalino ang kaniyang pananaw. Hindi rin siya yung too hard on us – she gives us the chance to expound on any subject matter.

Honestly, we enjoy her way of teaching us. Magaling talaga to the point na para na rin namin siyang barkada. “Why don’t you take up law?” biro niya sa akin while we were on a smoking spree sa labas ng ABS-CBN building during our 15-minute break.

I told her na hindi na siguro – my late dad was a brilliant lawyer; my uncle Romeo Sucaldito, Sr. was a former judge sa Pagadian City; my grandfather was also a judge noon sa Iloilo. Feeling ko kasi I am too old to go to a law school.

Marami ng responsibilities na nakaatang sa balikat ko – hindi ko na kakayanin. I want to live simply and take care na lang of my obligations. Masaya na ako as entertainment journalist ‘kako.

Sa isang discussion namin ay napunta kami sa anggulo ng mga common-law wife and the mana-mana thing. I learned one thing about it – akala ko kasi, pag common-law wife ka (hindi kasal) you don’t get any inheritance or you don’t get anything from your partner’s earnings once na maghiwalay kayo.

Sa pagkakaintindi ko kasi (dala ng kinalakihan kong paniniwala), pag namatay halimbawa ang partner mo at pag hindi ka specified sa last will and testament niya ay wala kang magi-gets.

At pag buhay naman ito at nakipaghiwalay lang sa iyo after living in for sometime ay luhaan ka financially. Hindi pala ganoon iyon. A common-law-wife from a separated man gets din pala 50% of the partner’s income from the time na nagsama sila.

Hindi lang siya kasali sa wealth ng partner niya na na-acquire nito before sila magsama. Unlike sa kasal na mag-asawa na hati talaga sa lahat (conjugal) kung wala silang pre-nuptial agreement.

May nagbato ng names nina Kris Aquino and Mayor Herbert Bautista kung halimbawa ma’y nagkatuluyan sila at nagsama. Si Kris kasi was formerly married and annulled na at merong legitimate son in Bimby while Bistek may have children too pero was never married.

May batas din pala riyan, since Kris was formerly married nga at merong anak, halimbawa’y nagsama sila ni Bistek at naghiwalay in the end, Kris deserves the 50% of whatever income na kinita ni Bistek from the time na nagsama sila pero Bistek cannot get anything from Kris dahil may anak ito from a legitimate marriage.

In short, win-win doon si Kris – wala siyang talo. Si Bistek lang ang lugi kumbaga.”Maaaring may isang brilliant lawyer na nag-advise kay Mayor Herbert na hiwalayan si Kris dahil kahit hindi sila kasal at pag nagsama sila, patay ang 50% ng kinita niya.

Ha-hahaha! Kakabig si Kris sa kaniya pero siya waley!” anang isang nag-comment. Maaaring ganoon kaya nakipaghiwalay na si Mayor Bistek. Ha-hahaha! Pero hindi naman siguro – hypothetical lang iyon.

Maaaring naghiwalay sila dahil hindi sila magkasundo on many things, or puwedeng talagang natauhan si Bistek na hindi niya kayang i-give-up ang relasyon niya with his common-law wife Tates Gana and their children na nag-iyakan when they learned that their dad got into a relationship nga with Kris.

“Or baka ginamit lang ni Bistek si Kris for his political ambition dahil balitang he’s running for senator in the 2016 polls,” sabat ng isa naming classmate sa said class.

Pero kung totoo nga, naging wise si Mayor Herbert na makuhanan ni Kris ng 50% of his potential income once na nagsama sila at naghiwalay – we may say na na-outsmart ni Bistek si Tetay roon. Ha-hahaha!
