MUKHANG mangyayari na ang kinatatakutan ni Tanya Bautista-Navarro na posibilidad na mailipat ang asawang si Vhong Navarro sa Taguig City Jail.
Kasalukuyang nakapiit ang komedyante sa National Bureau of Investigation detention center matapos matanggap ang warrant of arrest niya para sa kasong rape (non-bailable) na isinampa ni Deniece Cornejo noong 2014.
At nitong Huwebes, Setyembre 29 ay nagpetisyon ang kampo ni Deniece na ilipat si Vhong sa Taguig City Jail sa kadahilanang ang korte ng Taguig City ang naglabas ng warrant of arrest para sa criminal case ng komedyante.
Agad na naghain ng Urgent Motion ang kampo ng komedyante upang manatili sa NBI facility dahil na rin sa threat sa kanyang buhay.
Umiiyak na ibinahagi ni Tanya sa presscon noong Setyembre 21 na nakatanggap sila ng text message mula sa hindi kilalang sender na nagbabanta sa buhay ni Vhong.
Kaya naman nababahala ito para sa kaligtasan ng asawa sakaling mailipat ito sa Taguug City Jail.
“Lalaban kami, may case na, e. Lalaban kami at alam ko mapapanalo namin ito. But for the meantime, at least yung security niya, natatakot ako for him pag malipat siya sa Taguig,” bahagi ng salaysay ng asawa ni Vhong.
Pero hindi pinayagan ni Presiding Judge Loralie Cruz Datahan ng Taguig Regional Trial Court ang Urgent Motion ng kampo ng komedyante na mamalagi sa NBI detention center.
Ayon sa korte ay hindi raw sapat ang mga iprinisintang ebidensya ng kampo ni Vhong upang paboran ang kanilang petisyon.
“After a thorough consideration of the arguments of both the prosecution and the defense, the Court finds that accused was not able to justify the need for his continued detention at the NBI facility,” bahagi ng pahayag ng korte.
“While accused would want this Court to believe his legitimate fears for his life and security, he, however, fell short of substantiating the same.
“The SMS message allegedly received by the accused’s wife could not be given credence. First, the motion did not attach proof of SMS message and second, the said message, on its own, could be interpreted in so many different ways, not necessarily as a threat to the life and security of the accused.
“It must also be emphasized that the city jail is mandated to exercise great care so that the human rights of the prisoners are respected and protected. Thus, in the absence of any evidence to the contrary, the presumption of regularity in the performance of duties by the jail personnel prevails.”
At tuluyan na ngang na-denay ang inihaing motion ng kampo ni Vhong.
“Therefore, premises considered, the Urgent Motion for the National Bureau of Investigation to Retain Custody Over the Person of the Accused is hereby DENIED for lack of merit.”
