Petisyong nanawagan na isapubliko ang health condition ni Duterte walang legal na basehan–Panelo
SINABI ni Presidential Legal Counsel Salvador Panelo na walang legal na basehan ang inihaing petisyon sa Korte Suprema na humihiling na isapubliko ang lagay ng kalusugan ni Pangulong Duterte.
“The petition filed by a certain lawyer before the Supreme Court to compel PRRD to disclose the results of his medical exams or other health records warrants an outright dismissal,” sabi ni Panelo.
Ito’y matapos maghain ang isang Atty. Dino de Leon ng ‘extremely petition for mandamus’ sa Kataastaasang Hukuman na humihiling na isapubliko ang medical records ni Duterte.
“The petition does not have any factual or legal bases. The allegations arising therefrom are based purely on speculations. It is hornbook doctrine that a petition before a court of law cannot be anchored on mere conjectures or surmises,” ayon pa kay Panelo.
Idinagdag ni Panelo na walang isinumiteng ebidensiya si de Leon na magpapatunay na may seryosong sakit si Duterte.
“The Office of the Chief Presidential Legal Counsel also reminds petitioner that Article VII, Section 12 of the 1987 Constitution is clear, in that, the public shall be informed of the state of the President’s health only if he has a serious illness. Such is not the case here,” giit ni Panelo.
“The suit may have been a product of petitioner’s boredom as a result of the enhanced community quarantine. He may instead want to use his time by brushing up his law,” ayon pa kay Panelo.
