P200B forfeiture case vs Marcos ibinasura
IBINASURA ng Sandiganbayan special Fourth Division ang P200 bilyong forfeiture case laban sa pamilya Marcos at Constante Rubio dahil sa kakulangan ng ebidensya.
Sa 58-pahinang desisyon, sinabi ng korte na nabigo ang prosekusyon na patunayan ang alegasyon nito na nakaw ang yaman na binabawi kina dating Pangulong Ferdinand Marcos, dating First Lady Imelda Marcos, Sen. Imee Marcos, Irene Marcos at dating Sen. Bongbong Marcos. Si Rubio ang itinuturong bagman umano ng mga Marcos sa mga transaksyon nito.
“Wherefore, premises considered, for failure of the plaintiff to prove its allegations by preponderance of evidence, the subject Complaint filed against defendants Estate of Ferdinand Marcos…. is hereby Dismissed.”
Sinabi ng korte na bagamat kinikilala nito ang nangyaring “atrocities” noong Martial Law, kailangan na mapatunayan ang alegasyon sa pamamagitan ng mga ebidensya.
“On a final note, the Court acknowledges the atrocities committed during Martial law under the Marcos regime and the ‘plunder’ committed on the country’s resources. However, absent sufficient evidence that may lead to the conclusion that the subject properties were indeed ill-gotten by the Marcoses, the Court cannot simply order the return of the same to the national treasury.”
Kasama sa nais na ipakumpiska ng Presidential Commission on Good Government ang bilyong bank deposits, milyong halaga ng real properties, at mga stocks sa iba’t ibang kompanya.
