Hindi pinagbigyan ng Sandiganbayan Third Division ang hiling ni Vice President Jejomar Binay na ibasura ang kanyang kaso kaugnay ng umano’y overpriced na Makati City parking building.

    “After an assiduous evaluation of the arguments raised by the accused-movants in their respective motions to quash, together with the oppositions thereto of the prosecution, the court finds the said motions bereft of merit,” saad ng desisyon ng korte.     Si Binay ay nahaharap sa apat na kaso ng graft, malversation at siyam na kaso ng falsification of public documents. Ang anak niyang si dating Makati City Mayor Junjun Binay ay nahaharap naman sa dalawang kaso ng graft at anim na kaso ng falsification of public documents.     Inakusahan si Binay na pineke ang mga dokumento para sa naturang proyekto.     “To be sure, accused Binay Sr.’s insistence that conspiracy ‘must be shown to exist as clearly and convincingly as the commission of the offense itself’ is true only during the trial of the case and not as to the manner of alleging the same in the criminal information,” saad ng korte.     Sinabi ng Sandiganbayan na itutuloy nito ang pagdinig ng kaso dahil hindi nagpalabas ng temporary restraining order ang Korte Suprema.
