Rappler hiniling sa CA na ibasura ang desisyon SEC

HINILING ng online news outfit na Rappler sa Court of Appeals (CA) na baliktarin ang naging desisyon ng Securities and Exchange Commission (SEC) matapos itong tanggalan ng rehistrasyon dahil umano sa paglabag sa Konstitusyon kaugnay ng pagbabawal sa mga banyaga na magmay-ari ng media entity.

Sa 70-pahinang petition for review, sinabi ng Rappler Inc. at Rappler Holdings Corp.  na nilabag ng SEC ang kanilang karapatan sa tamang proseso matapos ang kautusan nito.

“There was also no formal administrative action filed against Rappler and RHC before the SEC. Without an administrative action, surely, no administrative action, including the suspension or revocation of the corporation’s franchise, could have been imposed by the SEC,” sabi ng Rappler.
Idinagdag ng Rappler na nagkamali ang SEC nang kanselahin nito ang certificate of incorporation ng Rappler at ipawalang bisa ang Omidyar Philippine Depository Receipts (PDRs).

“The Omidyar PDR does not confer upon Omidyar control, much less ownership and management, over Rappler. As such, the SEC has no basis to declare void the Omidyar PDR,” ayon pa sa Rappler.

Sinabi pa ng Rappler na dapat ay mangibabaw ang kalayaan sa pamamahayag sa kabila ng relasyon nito kay Pangulong Duterte.

“Judicial intervention is necessary to prevent a blatant exercise of prior restraint,” ayon pa sa petisyon.
