Ibinasura ng Sandiganbayan Fifth Division ang hiniling ni Sen. Jinggoy Estrada na makalabas ng kulungan para sa pagdiriwang ng kaarawan ng kanyang inang si dating Sen. Loi Ejercito.
Sinabi ng korte na hindi maaaring bigyan si Estrada ng karapatan katulad ng isang malayang tao.
“What the accused seeks is not of an emergency nature. Allowing the accused to hear Mass outside the confines of his prison would accord him the liberties of a free man with all the privileges appurtenant to his position. Such an aberrant situation not only elevates the accused’s status to that of a special class, it also would be a mockery of the purposes of the correction system,” saad ng desisyon.
Nais sana ni Estrada na dumalo sa ika-85 kaarawan ng kanyang ina sa Hunyo 5 mula 8 ng gabi hanggang 1 ng umaga kinabukasan. Gaganapin ito sa Blue Leaf, Filipinas Asiana City sa Paranaque.
“Penchant to the prior rulings of this Court save for allowing him in attending his son’s graduation ceremony, Senator Estrada cannot be granted furlough to attend his mother’s 85th birthday celebration,” dagdag pa ng desisyon ng korte.
Si Estrada ay nahaharap sa kasong plunder, isang non bailable offense, kaugnay ng paglalaan ng umano ng kanyang pork barrel fund sa mga non government organization ni Janet Lim Napoles kapalit ng kickback.
