Ex-education minister Iqbal sasampahan ng kasong kriminal sa Ombudsman

IPINAG-UTOS na ni Bangsamoro Autonomous Region in Muslim Mindanao (BARMM) Chief Minister Abdulraof Macacua ang pormal na pagsampa ng mga kasong kriminal at administratibo laban kay dating Education Minister Mohagher Iqbal sa tanggapan ng Ombudsman.

Ang mga kaso ay may kinalaman sa naging resulta ng special audit na isinagawa ng Commission on Audit hinggit sa umanoy maanomalyang pagbili ng may P2.2 bilyong halaga ng learning at training materials.

Sa kanyang sulat kay Iqbal, sinabi ni Macacua na ang pagsampa ng mga kaso ang magbibigay ay Iqbal ng pagkakataon na sagutin ang habla at linisin ang kanyang pangalan. 

Si Iqbal ay sinibak sa pwesto bilang Minister ng Ministry of Basic, Higher, and Technical Education (MBHTE) dahil sa naging resulta ng COA special audit.

Binalewala din ni Macacua ang sinabi ni Iqbal na hindi siya binigyan ng due process sa pagtanggal sa kanyang puwesto, dahil mismong ang pagsagawa ng special audit ay ebidensiya na ng due process.

“To provide you further the opportunity to invoke due process and ensure full accountability, I shall immediately forward the final COA findings to the Office of the Ombudsman so that the appropriate criminal and administrative proceedings may commence without delay,” sabi ni Macacua.

“In that forum, you will have every opportunity to be heard. But those proceedings do not bar the Chief Minister from ending a co-terminous appointment due to loss of confidence,” aniya pa.

Binanggit din ni Macacua and mga legal at factual na batayan ng pagsibak kay Iqbal at iginiit na hindi ito parusa tulad ng kanyang inaakala.

Ipinaalala ni Macacua kay Iqbal na ang kanyang appointment ay co-terminus sa Chief Minister hanggang may tiwala pa ito sa kanya.

Binanggit din ni Macacua ang isang Supreme Court ruling sa kasong Ong vs. Office of the President, et. al., kung saan sinabi ng korte na maaaring bawiin ng appointing authority ang co-terminus position sakaling mawalan na ang tiwala.

Sinabi pa rin ni Macacua na naging grabe ang resulta ng COA special audit dahil hindi lang si Iqbal ang nabahiran and dungis kundi ang buong reputasyon ng BARMM bilang institusyon.

“Moral governance demands that we act decisively when public trust is compromised. I have lost full confidence in your ability to lead MBHTE, and that loss of confidence is sufficient grounds for the expiration of your term,” sabi ni Macacua.

Sinabi pa ni Macacua na hindi dahil naging magkasama sila ni Iqbal sa adhikain sa Moro Islamic Liberation Front ay hahayaan niya na lang na masira ang BARMM.

“I do not take those lightly. But neither must we confuse brotherhood with governance and accountability, especially where corruption is alleged. 

“The struggle for the Bangsamoro was never about protecting each other from accountability; it was about building a just government. 

“Justice requires that no one, regardless of shared history, remain in office when corruption erodes public trust in the institutions we painstakingly built. Thus, trust and confidence are gone,” esplika ni Macacua.

Wala pang inilalabas na pahayag si Iqbal hinggil sa kautusan ng pagsasampa ng pormal na kaso laban sa kanya.
