Lorna Kapunan sa 1 kautusan ng korte sa petisyon ng Viva: This is a victory for Nadine

NAGLABAS na ng official statement ang abogado ni Nadine Lustre na si Atty. Lorna Kapunan tungkol sa resolusyon ng Quezon City Regional Trial Court sa isinampang petisyon ng Viva Artist Agency.

Ayon sa desisyon ng korte ay pinatatapos sa aktres ang kontrata nito sa Viva at hindi siya puwedeng tumanggap ng mga offer ng hindi alam ng VAA at walang go signal ng management.

Sabi nga ng abogado ng Viva na si Atty. Paolo Roxas, “With the Court’s ruling, Nadine is precluded from entering into and/or performing contracts involving her services as an artist/endorser, without the consent and participation of Viva. 

“As provided by her contract, any issue raise by Nadine against Viva should be the subject of arbitration proceedings,” ang nakasaad pa sa resolusyon.

Sa panayam naman ni Nadine kay Boy Abunda, sinabi nito na napakarami niyang natutunan sa mga isyu at kontrobersyang pinagdaanan niya nitong nakaraang mga taon. 

At kung may isang bagay siyang ipinagpapasalamat, “Being here. Being where I am now. And the mindset that I have now. ‘Cause I’ve learned a lot and I’m grateful for all the things that happened in my life because if it weren’t for those, I wouldn’t be who I am now.”

Nabanggit din ni Nadine na ipinagkatiwala na niya sa abogado niya ang tungkol sa isyung ito, “Well, I trust naman that Atty. Lorna can help me out on this and I’m just leaving it up to them.”

Binasa naman ni kuya Boy ang official statement ni Atty. Kapunan: “The court denied VIVA’s claims for attachment and garnishment of Nadine’s hard-earned earnings and bank account. This is a victory for Nadine.

“The court, however, granted status quo order in consideration of rights of third party rights to Nadine’s termination of its contract with VIVA.

“But the issue of whether there’s a valid contract between VIVA and Nadine was not decided by the court which said this issue is subject to arbitration proceedings and not the court.

“Nadine has fulfilled and continues to respect the prior contracts with third parties even after she terminated the agreement with VIVA for various material breach committed by VIVA.”

Dagdag pa ni Kapunan tungkol sa kinukuhang 40% komisyon ng Viva kay Nadine, “We are filing a motion for reconsideration on the status quo order. Nadine will continue the concert and pending contracts that VIVA will be claiming their 40 percent commission.

“VIVA will also be notified of future engagements of Nadine pending that arbitrable issue of her VIVA agency management agreement.”
