DAPAT umanong maging malinaw ang Implementing Rules and Regulation ng Anti-Terrorism Act upang matiyak na hindi ito gagamitin upang supilin ang karapatan ng publiko.
Ayon kay Puwersa ng Bayaning Atleta (PBA) Rep. Jericho Nograles dapat maisama sa IRR ang bahagi ng batas kaugnay ng pananagutan ng mga opisyal at tauhan ng gobyerno na aabusuhin ang paggamit nito.
Ang tinutukoy ni Nograles ay ang otomatikong paghahain ng kasong kriminal, administratibo at sibil sa sinumang aabuso sa kanilang paghuhusga kung sino ang tutukuying terorista.
“The safeguards in the law must be clear in the implementing rules and regulations to be very sure that the anti-terror law will only be used against terrorists,” ani Nograles.
Ipinunto ni Nograles na kailangan ang Anti-Terrorism law dahil ang Pilipinas ang pang-siyam at nag-iisa sa Southeast Asia na nasa top 10 na may pinakamataas na epekto ang terorismo batay sa Global Terrorism Index of 2019.
“The Human Security Act of 2007 (RA 9372) is not enough to fight the evolved nature of terrorism. As an example, our law enforcement and security forces are cannot go after a foreign terrorist in our own land because we have not yet legally defined a foreign terrorist until this Anti-Terror Bill. I believe if the President signs the Bill into Law, the foreign terrorists will think 1,000 times before entering the Philippines again,” ani Nograles.
Sa ilalim ng IRR ng RA 9372 ay wala umanong special provision upang maproteksyunan ang civil rights at nais ni Nograles na magkaroon nito sa IRR ng Anti-Terrorism Act na inaprubahan ng Kongreso at pirma na lamang ni Pangulong Duterte ang kulang upang maisabatas.
“The threat of terrorism is a clear and present danger now. People forget that just last year, we had our first suicide bombing in Jolo and in that suicide bombing, there was an actionable intelligence to prevent such suicide bombing. However, the Human Security Act of 2007 does not enough teeth that would have allowed us to stop the suicide bomber even before he could carry out his mission,” saad ni Nograles.
Sa ilalim ng bagong batas, maaari nang arestuhin ng otoridad ang isang tao na nais maging suicide bomber sa oras na nagsimula itong mangolekta ng materyales para sa paggawa ng bomba.
