I write you to seek labor advice. In my case, I worked in an oil milling company here in Quezon Province. Nakatatlong taon po akong mahigit at dahil nagkaroon po ako ng karamdaman, halos madalas po akong di makapasok ng trabaho.
Dahil diyan ay kinausap po ako ng aking supervisor at sinabihan po akong mag-resign na lamang.
Napilitan po akong sundin para po mapanatag na lang ang aking saloobin. Bagamat mabigat sa loob kong mag-resign dahil kailangan ko po ng trabaho para mabuhay ang pamilya ko at ang tustusan sa pag-aaral ng aking limang anak.
Ang isang kagaya ko bang maliit na mangagawa ay may karapatan pang makakuha ng separation pay?
Magkano po kaya kung meron man?

REPLY: The length of service will only be a factor in the computation of separation pay which a resigned employee is not entitled to receive.
Separation pay is given to employees in instances covered by Articles 298 and 299 (formerly Articles 283 and 284) of the Labor Code of the Philippines.
Resigned employes will only receive last pay, which may include last salary (if withheld), proportionate 13th month pay, unused service incentive leaves and other claims (such as cash bond).
