MAGANDANG araw po sa Aksyon Line. Last year pa po ako nag resign sa aking trabaho sa isang advertising company sa Makati pero hanggang ngayon ay hindi pa po ibinibigay ang mga benefits na dapat kong matanggap. Gusto ko po sanang itanong sa DOLE kung ano ang dapat kong gawin. Mala-king tulong po ang makukuha ko na kahit papaano ay pandagdag sa gastusin sa pag aaral ng mga bata. Ano rin po ang dapat kong ga-win gayung nag resign na ako sa aking trabaho at ngayon ay grab driver? Sana ay agarang masagot ng DOLE ang aking katanungan. Salamat po and more power!

REPLY: The law is silent regarding fixed period when to release the monetary benefit but it only qualifies “within the reasonable period”.
Based on jurisprudence and other companies’ practice, 30 to 90 days the reasonable period in releasing such benefits.
Since you are voluntarily resigned employee, what you can receive are the following (1) prorated 13th month pay, (2) last pay (last cut off), and (3) the monetary value of your unused leave credits, provided it is in the company policy provision or CBA.
Some company policies or CBA, provide separation pay for voluntarily resigned employee but the Labor Code has no provision for that voluntarily resigned employee unless he/she is terminated under authorized causes, then separation pay is entitled to the said employee.
If you think your waiting is reasonable enough after numerous follow-ups you have made, then you can file complaint at DOLE field office for possible action and assistance to release your monetary claims.
You can ask DOLE’s program of livelihood if you can qualify to avail of such livelihood program to add up your means of income. Please see or visit DOLE Regional office in your place or region where you are situated. Thanks!
