GOOD morning po, tanong ko lan po kung anu po talaga ang batas sa contractual project basis na kontrata especially dito sa construction business. kasi po marami sa mga empleyado ng lahat ng contractor sa atin bansa ay project basis lan kya everytime na matatapos ang project eh ililipat lan ng ibang site at masakit dun eh kahit mga engineers ganun ang patakaran kya mostly nakailang taon na sa kumpanya eh hindi pa din maregular at walang makuhang benepisyo ( 5 days incentive leave lang) wala man lang sick leave. Dito kalimitan na after so many years (5 years or more) at maubusan ng project ang engineer eh wala makuha man lang na separation pay or gratuity pay. Unlike sa government employee after years of service eh may separation pay or retirement benefits. Tanong ko lang sana kung ang contractual basis ba na kontrata eh effective lang for the initial project and if ever nacomplete mo yun project at kailangan ka uli ng companya at ililipat ka sa ibang project eh dapat ba automatic kna na gawing regular employee na.

REPLY: Under Article 281 of the Labor Code of the Philippines, Project Employment is defined when an employee is hired for a specific project or undertaking and the employment duration is specified by the scope of work and/or length of the project. A project employee may acquire the status of a regular employee when they are continuously rehired after the completion of the project or when the tasks they perform are vital, necessary, and indispensable to the usual business or trade of the employer.

To relate such law, it governs the criteria or necessary requirement for an employee to be regular in status.

As to service incentive leave (SIL) as mandatory leave benefit of an employee, it could either be treated or be used as sick leave or vacation leave. Other than that leave benefit, some companies as provided in their policy – offer or give voluntary leave benefits as additional leave benefits added to SIL.

In claiming separation pay, an employee is entitled to this if he/she is terminated due to authorized causes as provided by law.

Gratuity pay is management prerogative or a concerted agreement of the company policy or existing Collective Bargaining Agreement (CBA).

The sender is right on his thought that if the company has been giving projects in continuous or broken period, he can be qualified as regular employee provided he meets the foregoing criteria cited for regular status of employment.
