Fresh graduate po ako ng kursong BSHRM. Wala pa pa akong alam ba mga karapatan ng isang empleyado.
Nagtrabaho po ako sa isang fastfood resto bilang cashier. Bago pa lang po ako ay nagsabi na akong magre-resign dahil sa nai-stress ako. 20 days lang ang naipasok ko. Nakasahod po ako ng P2,281 for five days
At noong sumunod na sahod ay nagulat po ako dahil wala nang laman ang ATM ko. Kaya pinuntahan ko po ‘yung pinagtrabahuan ko at tinanong ko kung bakit wala akong sahod.
Ang sabi po akin ay hinold po ang sahod ko dahil nag-resign na daw po ako. Sinabi ko naman po na nagsabi nga ako na magreresign, pero hindi pa pa ako nakakapasa ng resignation letter.
Ang sagot sa akin ay verbal daw po ang pagre-resign ko at policy daw po iyon ng company kahit saan ako magtanong at magpunta.
Tinanong ko rin po kung kailan ko po makukuha ang sahod ko, pero hindi po ako masagot ng maayos.
Tinanong pa ako kung papasok pa ako ang sabi ko po pumapasok naman ako.
Naiinis na nga po ako dahil hindi po ako masagot ng manager kung kailan ko makukuha ang sahod ko. Kaya po sinabi ko po na paano pa po ako papasok kung hinold nga nila ang dapat kong makuha.
Tanong ko lang po kung pwede po ba ang verbal resignation? Wala naman pong patunay na nag-resign ang isang empleyado, di ba?
Pwede po ba i-hold ang sahod ng isang empleyado na walang abiso o alam ang isang empleyado?
Pwede ko po bang malaman kung totoong policy po nila na kapag nagsabi ang isang empleyado na magre-resign kahit walang resignation letter ay pwede po nila i-hold agad ang sahod?
Makukuha ko pa po ba ‘yung 15 days ko na naipasok sa kanila?

REPLY: Here are the answers of the letter-sender’s queries:
1. Kung pwede po ba Ang verbal resignation? Wala pong patunay na nag-resign ang isang empleyado?
Answer:
The Labor Code requires the employee to give an advance notice to the employer of his intention to resign. The notice of resignation must be in writing and must be served to the employer at least one month prior to the effective date of his resignation.
Resignation notice usually takes the form of a letter (commonly called “resignation letter”) addressed to the employer, expressing the employee’s intention to terminate his employment. It must state the date when resignation is to take effect because of the 30-day notice requirement under the law. It may also contain the reason or justification of the employee for filing his resignation, although legally, this is not important. The employee may resign for whatever reason, or even for no reason at all. Thus, in legal parlance, voluntary resignation is also called “termination by employee without just cause.”
Resignation letter normally contains explicit words expressing employee’s intention to terminate his employment.
However, lack of explicit words stating the employees intention to resign is deemed not crucial, as long as the employees intention to resign can be deduced from letter itself.
2. Pwede po bang i-hold ang sahod ng isang empleyado na walang abiso o alam ang isang empleyado?
Answer:
It is against Article 116 of the Labor Code that prohibits withholding of wages and kickbacks without proper consent of the employee.
Article 113 however provides for certain exemptions to the general rule, it states that no employer in his own behalf, or in behalf of any person, shall make any deductions from wages of his employees, except for insurance premiums, union dues, or ‘in cases where the employer is authorized by law or regulators issued by the Secretary of Labor and Employment. On the other hand, Article 1706 of the Civil Code also prohibits employers from withholding wages except for a debt one.
3. Pwede ko po bang malaman kung totoong policy po nila na kapag nagsabi ang isang empleyado na magre-resign kahit walang resignation letter pwede na po nila i-hold agad ang sahod?
Answer: As an employee, you have the right to know the company policy since you are connected, employed, and binding to adhere the rules and regulations in the workplace. Thus, it is your duty to know these rules or policies governing your work.
4. Makukuha ko pa po ba ‘yung 15 days ko na naipasok sa kanila?
Answer:
Yes, you will receive your 15-day pay after complying with the clearance to prove that you are cleared from accountability and has turnover whatever documents issued or on her possession. Thanks.
