Abaya kakasuhan kaugnay ng P4.2B MRT3 maintenance contract

NAHAHARAP si dating Transportation Sec. Joseph Emilio Abaya at 16 na iba pa kaugnay ng maanomalya umanong P4.2 bilyong maintenance contract ng Metro Rail Transit 3.

Ang kaso ay mas mababa sa reklamong plunder na inihain ng mga tumutuligsa sa kontratang pinasok ng Department of Transportation noong panahon ni Pangulong Benigno Simeon Aquino III.

Inaprubahan ni Ombudsman Conchita Carpio Morales ang pagsasampa ng graft laban kay Abaya, DOTr Undersecretaries Edwin Lopez, Rene Limcaoco at  Catherine Jennifer Francis Gonzales, ex-MRT3 General Manager Roman Buenafe, Camille Alcaraz (Assistant Secretary for Procurement), Ofelia Astrera (Vice-Chairperson, MRT3 Bids and Awards Committee), Charissa Eloisa Julia Opulencia (Attorney V), Oscar Bongon (Chief, Engineering Division) at Jose Rodante Sabayle (Engineer III).

Kasama rin sina Eldonn Ferdinand Uy ng Edison Development and Construction, Elizabeth Velasco ng Tramat Mercantile Incorporated, Belinda Tan ng TMI Corporation, Inc., Brian Velasco ng Castan Corporation, at Antonio Borromeo, Jun Ho Hwang at Elpidio Uy ng Busan Universal Rail, Inc.

Ayon sa imbestigasyon, nabigo ang dalawang bidding para sa tatlong taong maintenance service contract para sa MRT3 matapos na walang magsumite ng bid.

Dahil dito inirekomenda ni Abaya noong Marso 2015 ang pagpasok sa Negotiated Procurement through Emergency Cases.

Ang idineklara na tanging pumasa sa kuwalipikasyon ay ang Busan Joint Venture.

Taliwas ito sa resulta ng imbestigasyon ng Ombudsman na nagsabi na ang Busan JV ay isang “ineligible and unqualified entity”.

“As another favorable concession to the Busan JV, the Negotiating Team then decided that in lieu of the 20% equity requirement, the Busan JV should enter into a Management and Facility Maintenance Services Agreement with Busan to ensure that the MRT3 long-term maintenance contract will be undertaken by a company with the required track record and necessary expertise and experience on railway maintenance.  Clearly, efforts were exerted to retain Busan in the JV to fulfill the minimum requirements under the Instructions to Offerors.”
