Sa desisyon, sinabi ni Manila RTC Branch 40 Presiding Judge Alfredo Ampuan na nakakita ng probable cause para kasuhan sina Mhin Weig Chan, Jose Miguel Salamat, John Robin Ramos, Marcelino Bagtang Jr., Arvin Balag, Ralph Trangia, Axel Munro Hipe, Oliver Onofre, Joshua Joriel Macabali, at Hans Matthew Rodrigo, na pawang mga miyembro ng Aegis Juris fraternity.
Noong isang buwan, sinipa ng University of Sto. Tomas (UST) ang walong law student na isinasangkot sa pagkamatay ni Castillo, bagamat hindi na pinangalan ang mga ito.
“Upon personal evaluation of the resolution of the DOJ Panel of Prosecutors as well as all the supporting evidence on records, this Court finds probable cause and that there is a necessity for placing all the accused under custody in order not to frustrate the ends of justice,” sabi ng korte, sa pamamagitan ni Presiding Judge Alfredo D. Ampuan.
Nahaharap ang 10 akusado sa paglabag sa Republic Act 8049 o Anti-Hazing Law kung saan walang piyansa ang inirererekomenda sa mga akusado.
