Pahirapan ang pagbibigay ng COE, back pay

GOOD day,

Masugid po akong tagasubaybay ng Inquirer at gaya ng napakaraming natulungan po ninyo, sana po ay matulungan n’yo rin po ako.

Ako po si Perlie Oczon, 28 years old, kasalukuyang nakatira sa Antipolo at nagtatrabaho sa isang ospital.

Sa ngayon po ay nagaayos po ako ng mga requirements sa bago ko pong pinagtatrabahuhan, at isa po roon ay ang makakuha ako ng certificate of employment at back pay sa company na pinagtrabahuhan ko.

Umalis po ako at nag file ng immediate resignation last August 2017 sa kumpanyang formerly known as “ARRIVA MEDICAL PHILIPPINES” na sa ngayon ay nabili na at pag-aari ng “ABBOTT” ngunit patuloy pa rin po ang operation ng kanilang H.R Department sa BGC Taguig. Nakapag cleareance na po ako sa kanila at naibalik ang lahat ng company assets at meron na rin po akong acceptance letter from HRD at exit clearance form, ngunit sinabi po nila na ii- schedule na lang daw nila ang aking exit interview.

Dumating na po ang January 2018 at nag-follow up po ako ng aking C.O.E at backpay sa HR number na nakuha ko pa po sa Jobstreet upang sila ay ma’ contact dahil wala pong sumasagot sa phone number nila, at sabi po ng HR staff na nakausap ko- “MAARI DAW NILANG I’ RELEASE ANG C.O.E KO PERO HINDI SYA SURE SA BACK PAY KO KUNG MARI-RELEASE DAW NILA”. Pnaghirapan ko po ang perang yun at sino po ang makikinabang na iba kung hindi nila yun ibibigay sa akin?

Pero nag text po ulit sya at nagbigay ng date kung saan maari kong makuha ang aking c.o.e, halos 1week ko pong tinitext/call kung ano ang best time na magpunta sa opisina nila pero wala pong reply, nagpunta po ako ron last February 9 2018, 1PM all the way from Antipolo to BGC Taguig, nag-absent pa po ako pero ang start pa raw ng shift nila is 9 p.m.

Sobrang maluha-luha po talaga ako sa pagod, oras, trabaho at perang sinayang ko po pamasahe balikan. Kinagabihan po nagtext ang isa sa H.R nila at tumawag na rin po at sa call at sinabing nagdesisyon na sa February 16, 2018 nalang ibigay ang COE at backpay ko po.

Nagpunta na naman po akong muli, all the way from Antipolo to Taguig BGC para lang po roon at nakarating ng pasado 10 p.m. pero wala po palang H.R na nakashift ang may kakayahang mag release daw ng c.o.e at backpay ko po sabi ng security on shift.

Sobrang sama po ng loob ko sa ginagawa nila dahil inaasahan ko po sanang pambili yun ng gamot ng mama ko sa Highblood nya.

REPLY: Good afternoon! Our Labor Code provides that last pay of an employee who resigned from his work shall be received upon completing the clearance within a reasonable period.

An employee also has the right to receive his Certificate of Employment as the Labor Code states that a dismissed (terminated or resigned) worker shall be entitled to be given, on request, a certificate from his/her employer specifying the dates of his/her engagement and termination and the type or types of work on which he/she was employed.

In connection with your concern, you may file a Request For Assistance (RFA) under the DOLE Single Entry Approach (SEnA) program before our DOLE Regional/Provincial /Field Office which has jurisdiction over your workplace.
