Pinangunahan ni Albay Rep. Edcel Lagman ang paghahain ng petisyon sa Korte Suprema kahapon.
Hiniling din ng mga petitioner sa Supreme Court na maglabas ng temporary restraining order sa pagpapatupad ng martial law at suspensyon ng writ of habeas corpus mula Enero 1 hanggang Disyembre 31, 2018.
Ayon sa petisyon wala ng batayan upang palawigin pa ang martial law lalo at wala ng aktwal na rebelyon sa Mindanao.
Kinuwestyon din ng mga petitioner ang paspasan umanong pagpasa ng resolusyon ng Senado at Kamara de Representantes para sa martial law extension.
“Threats of violence and terrorism by remnants of vanquished terrorist groups do not constitute a constitutional basis for extension of martial law because “imminent danger” has been deleted as a ground for imposing martial law under the 1987 Constitution,” saad ng petisyon.
Naniniwala si Lagman na hindi pinapayagan ng Konstitusyon ang re-extension ng martial law na maaaring maging walang katapusan.
“The congressional grant of re-extension has no factual anchorage and is afflicted by grave abuse of discretion,” saad ng petisyon. “The President as Commander-in-Chief has the power to call out the armed forces to prevent and subdue lawlessness by remnants of terrorist groups without extending martial law and the suspension of the writ of habeas corpus in Mindanao.”
Kasama ni Lagman bilang petitioner sina Representatives Tomasito Villarin (Akbayan), Edgar Erice (Caloocan), Teddy Brawner Baguilat, Jr. (Ifugao), Gary Alejano (Magdalo) at Emmanuel Billones (Capiz). Hindi nakasali si Rep. Raul Daza sa petisyon.
