Tuloy ang pagdinig ng Sandiganbayan First Division sa kaso ni North Cotabato Gov. Emmylou Talino-Mendoza.
Ito ay matapos na sabihin ng korte na mayroong probable cause ang inihaing kaso ng Ombudsman at ibasura ang mosyon ng gubernadora.
“This Court has found that there is indeed probable cause to hold the accused for trial for violation of Section 3(e) of RA 3019 (Anti-Graft and Corrupt Practices Act),” saad ng desisyon ng korte.
Noong Abril 18 ay naglabas ng desisyon ang korte na mayroong probable cause ang isinampang kaso kay Mendoza bago pa man magsagawa ng pagdinig sa inihain nitong Motion for Judicial Determination of Probable Cause.
Kaya ang mosyon ay ginawa na lamang Motion for Reconsideration sa desisyon. Sinabi ng korte na wala itong nakitang batayan upang baliktarin ang desisyon nito.
“The accused has not advanced the any ground or argument sufficient to warrant a reconsideration of the Court’s previous ruling.”
Ang kaso ay nag-ugat sa pagbili ng kapitolyo ng produktong petrolyo sa Shell gas station na pagmamay-ari ng ina ni Mendoza na nagkakahalaga ng P2.4 milyon. Hindi rin umano ito dumaan sa public bidding.
Sinabi ng korte na kahit na sabihin ni Mendoza na walang pinsalang nagawa ang transaksyon, hindi umano nangangahulugan na walang paglabag sa batas na nagawa.

Ibinasura na rin ng korte ang hiling ni Mendoza na huwag magpalabas ng warrant of arrest matapos itong maglagak ng P90,000 piyansa.
