Arrest warrant, HDO vs North Cotabato gov

sandiganbayan Mayroong nakitang sapat na batayan ang Sandiganbayan First Division upang magpalabas ng warrant of arrest at hold departure order laban kay North Cotabato Gov. Emmylou Talino-Mendoza kaugnay ng kinakaharap nitong mga kaso dahil sa pagbili ng P2.4 milyong gasolina sa gasolinahan ng kanyang ina. “After perusing the Informations and evaluating the resolution of the prosecutor, the evidence in support thereof and the records of the preliminary investigation attached hereto, the Court finds that sufficient grounds exist for the finding of probable cause for the purpose of issuing a warrant of arrest against the accused charges in the instant cases,” sad ng isang pahinang resolusyon. Si Mendoza ay nahaharap sa tatlong kaso ng paglabag sa Anti-Graft and Corrupt Practices Act. Ayon sa prosekusyon, pinayagan ni Mendoza ang pagpapalabas ng P2.4 milyong pondo ng probinsya para sa pagbili ng 49,526.72 litro ng gasolina para sa road grader at apat na dump truck na ginamit sa dalawang araw na rehabilitation project sa lalawigan noong 2004. Hindi umano dumaan sa public bidding ang pagbili kundi direkta umanong bumili ang probinsya sa Shell station na pagmamay-ari ng ina ni Mendoza. Nauna ng naghain si Mendoza ng mosyon upang ibasura ang kaso dahil aprubado umano ng Bids and Awards committee ng lalawigan ang naturang transaksyon at ang direct contracting ay matagal na umanong ginagawa sa probinsya.
