3 ex-AFP generals, 2 pa guilty

  sandiganbayan Guilty ang hatol ng Sandiganbayan Second Division sa tatlong dating opisyal ng militar kaugnay ng mali umanong paggamit nila sa P250 milyong retirement fund ng Armed Forces of the Philippines noong 1996.      Hinatulan na makulong ng 14 hanggang 20 taon sina retired AFP Brigadier General Jose Ramiscal Jr., dating pangulo ng AFP-Retirement and Separation Benefit System; Julian Alzaga, dating hepe ng AFP-RSBS Legal Department at Manuel Satuito dating hepe ng AFP-RSBS Documentation Department at ang private respondent na si Elizabeth Liang at Jesus Garcia, mga may-ari ng Concord Resources Inc.      Sila ay napatunayang guilty sa kasong Malversation of public funds through falsification of public documents sa ilalim ng Revised Penal Code.      Pinagmumulta rin ang bawat isa sa kanila ng P250.3 milyon.      “In the entire scheme of things, all the accused, Ramiscal, Alzaga, Satuito, Liang and Garcia performed acts vital to the completion and accomplishment of a plan, that is, to defraud the Government,” saad ng 36 pahinang desisyon.      Ayon sa desisyon ng korte nagsabwatan ang mga akusado sa pamemeke ng deed of sale upang palabasin na binayaran ng AFP-RSBS ang Concord resources ng P341.3 milyon para sa apat na lupa sa Brgy. Makiling, Calamba, Laguna na para sa housing project ng mga sundalo.      Sa imbestigasyon ng Ombudsman, ang lupa ay nagkakahalaga lamang umano ng P91 milyon batay sa notaryadong registered deed of sale.      Hindi binigyan ng bigat ng korte ang depensa ni Ramiscal na pineke lamang ang kanyang pirma niya sa deed of sale na may halagang P91 milyon at ang totoo umano niyang pirma ay ang deed of sale na may presyong P341.3 milyon.      “The burden of proof is on him (Ramiscal) who alleges fraud. Forgery is not presumed, it must be proved by clear, positive and convincing evidence. A mere allegation is not evidence,” saad ng desisyon.      Sinabi rin ng korte na mukhang magkapareha ang pirma sa dalawang dokumento at hindi umano notaryado ang  deed of sale na may P341 milyong presyo.      “As between the two subject deeds of sale, it is that for P91,024,800 that is sustained as valid, the genuineness thereof not having been completely destroyed albeit attempted. And significantly, it was that document notarized at that, hence, a public document, which enjoys the presumption of regularity and is prima facie evidence of the truth of the facts narrated therein,” saad ng desisyon. 30
