Inihain sa Kamara de Representantes ang panukala na magkaroon ng absolute divorce sa bansa.
Sinabi ni Albay Rep. Edcel Lagman na ang divorce ay para sa mga tao na hindi na masaya sa kanilang kinakasama at kung ang pagpapatuloy ng kanilang relasyon ay nakasisira na sa kanila.
“Most marriages are supposed to be solemnized in heaven, the reality is many marriages plummet into hell – in irremediable breakdown, spousal abuse, marital infidelity and psychological incapacity, among others, which bedevil marriages,” ani Lagman sa House bill 116.
Sinabi ni Lagman na ang Pilipinas na lamang ang nag-iisang bansa sa mundo na walang absolute divorce. Noong 2011 ay bumoto ang Malta pabor sa pagsasabatas nito.
“While the State continues to protect and preserve marriage as a social institution, it gives the opportunity to spouses in irremediably failed marriages to secure an absolute divorce decree under limited grounds and well-defined procedures to avoid abuse, save the children from the pain and stress of their parents’ marital clashes, and grant the divorced spouses the right to marry again for another chance to achieve marital bliss.”
Sinabi ni Lagman na ang absolute divorce ay hindi rin dapat mahal at kaya maging ng mga mahihirap.
Ang mga dahilan para makakuha ng legal separation ay siya ring mga dahilan na maaaring magamit para makakuha ng divorce. Ang mga ito ay marital abuse, sexual infidelity, tangkang pagpatay sa asawa, pag-abandona, de facto separation, kapag nahatulan sa ginawang krimen na mahigit sa anim na taon ang parusang kulong, bigamous marriage, drug addiction o habitual alcoholism, lesbianism at homosexuality.
