Ricky Reyes talo sa labor case na isinampa sa kanya ng HIV positive na hairstylist

BUTATA ang celebrity hairstylist na si Ricky Reyes nang kampihan ng korte ang empleyado nito na nnaghain ng labor case laban sa kanya dahil sa umano’y pagsibak sa kanya sa trabaho dahil nagpositibo siya sa HIV.
Sa press statement na ipinadala ng Associated Labor Unions-Trade Union Congress of the Philippines, sinabi nito na pinababalik sa trabaho ang 47-anyos na si Renato Nocos, hairstylist ni Reyes.
Sa utos na inilabas ng National Labor Relations Commission labor arbiter na si Joanne Hernandez-Lazo inutusan nito si Reyes at business partner nitong si Tonneth Moreno na ibigay kay Nocos ang salary differentials, emergency cost of living allowances, 13th month pay, separation pay at pinababayaran din ang ginastos ni Nocos sa kaso.
Umaabot ang kabuuang halaga nito sa P615,313.06.
Inilipat umano si Nocos sa isang parlor ni Reyes na malapit ng magsara ng malaman nila na mayroon itong sintomas ng HIV. Nang magsara ang naturang branch ay hindi na siya muling kinuha.
“HIV illness is not highly contagious and it is not transmitted through touching, hugging, sneezing, coughing, eating or drinking common utensils or being around an infected person. Thus, the means by which they (Reyes et al) tried to protect their other employees and customers unduly trampled upon the rights of the complainant (Nocos),” saad ng 10 pahinang desisyon na hawak ng TUCP.
Nawalan ng trabaho si Nocos noong Pebrero 28, 2014 matapos na isiwalat umano sa kanyang mga boss na siya ay may HIV. Noong Hulyo 16, 2003 pa siya nagtatrabaho roon.
Naghain din si Nocos ng hiwalay na reklamo dahil sa hindi umano pagreremit ng kanyang premium sa Social Security System at Philhealth.
Ikinatuwa naman ni ALU national executive vice president Gerard Seno ang desisyon ng NLRC.
“Oppression like this happens because there are still a great majority in our society whose judgment calls are still guided by their ignorance about HIV and AIDS. Labor unions feel there’s a strong need to combine and connect the old and the new paradigms about HIV and AIDS in order to minimize stigma and discrimination surrounding the phenomenon,” ani Seno.
