Sinampahan ng kasong graft ng Office of the Ombudsman si dating Metro Rail Transit 3 general manager Al Vitangcol III at limang iba pa kaugnay ng maanomalya umanong kontrata sa tren noong 2012.
Kasama sa kaso sina PH Trams incorporators Wilson De Vera, Marlo Dela Cruz, Manolo Maralit, Federico Remo at Arturo Soriano, na uncle-in-law ni Vitangcol.
Ang kaso ay kaugnay ng pagbibigay umano ng MRT ng kontrata sa Philippine Trans Rail Management and Services Corp. noong Oktobre 2012 kahit dapat ay diskuwalipikado ito matapos na hindi makasunod sa government procurement rules.
Sa ilalim ng kontrata magbabayas ang MRT ng $1.15 milyon kada buwan para sa maintenance ng MRT3.
Nagsabwatan umano ang mga akusado sa maanomalyang kontratang ito.
Mayroon din umanong paglabag dahil si Soriano ay tiyuhin ng asawa ni Vitangcol. Nagsinungaling din umano ang PH Trams ng sabihin nito na wala silang incorporator na may kaugnayan sa mga miyembro ng Bids and Awards Committee, Technical Working Group, BAC Secretariat, at Head ng Project Management Office.
“In fact, as all the accused knew, accused Soriano, one of the PH Trams’ incorporators, in an uncle-in-law, a relative by affinity within the third civil degree of accused Vitangcol…which fact, if not concealed by the accused, would have automatically disqualified PH Trams from participating in the procurement of the interim maintenance contract of MRT3,” saad ng reklamo.
Inirekomenda ng prosekusyon ang P30,000 piyansa sa bawat akusado kapalit ng pansamantalang kalayaan ng mga ito.
